The distinction between the United Kingdom and the Crown Dependencies is one that most people never need to think about - until they try to get a document from Jersey, Guernsey or the Isle of Man apostilled by the FCDO and it is returned without legalisation. The reason is jurisdictional: the Crown Dependencies are not part of the United Kingdom, and the FCDO's authority to issue apostilles extends only to documents originating from England, Wales, Scotland and Northern Ireland.
The constitutional position
Jersey, Guernsey and the Isle of Man are self-governing possessions of the British Crown. They have their own legislative assemblies, their own legal systems and their own courts. The UK Government is responsible for their defence and international relations, but does not administer their internal affairs. For the purposes of the Hague Apostille Convention, each Crown Dependency has designated its own competent authority to issue apostilles - just as the UK designated the FCDO for documents originating from the four nations of the United Kingdom.
Where to obtain an apostille for a Crown Dependency document
For a document issued in Jersey, the apostille is obtained from the Jersey Legalisation Office. For a document issued in Guernsey - which includes documents from Alderney and Sark - the apostille is obtained from the Guernsey Greffe. For a document issued in the Isle of Man, the apostille is obtained from the Isle of Man Courts of Justice. Each of these authorities follows the Hague Convention standards. The apostille they issue is internationally valid and carries the same legal standing as one issued by the FCDO.
When the Crown Dependency apostille is sufficient on its own
For any country that is a member of the Hague Apostille Convention, an apostille issued by the relevant Crown Dependency authority is the complete authentication. No UK FCDO apostille is additionally required. The receiving authority is obliged under the Convention to accept the apostille regardless of which competent authority issued it.
